Peter Obi files Supreme Court appeal against Tinubu’s election

Mr Obi accused the appeal court of “grave miscarriage of justice”.

The presidential candidate of the Labour Party, Peter Obi, has filed an appeal at the Supreme Court, challenging the judgement of the presidential election petition court which upheld President Bola Tinubu’s election.

Mr Obi raised 50 grounds of appeal on Tuesday, saying the appeal court erred in law when it dismissed his petition against the outcome of the Feb. 25 poll.

The Court of Appeal on Sept. 6 said petitions filed by the Labour Party and the Peoples Democratic Party against Mr Tinubu lacked merit. The five-member panel said Mr Obi and former vice president Atiku Abubakar of the PDP failed to prove their cases.

Mr Abubakar had earlier submitted his challenge on Tuesday.

In his appeal to the Supreme Court, Mr Obi accused the appeal court of “grave miscarriage of justice”.

He faulted the court for dismissing his case on the premise that he did not specify the figures of votes or scores that were allegedly suppressed of inflated in favour of Mr Tinubu and the ruling All Progressives Congress, APC.

Mr Obi said the court breached his right to fair hearing and wrongly dismissed testimonies made by his witnesses.

The LP candidate said the appeal court unjustly dismissed his position that the Independent National Electoral Commission uploaded 18, 088 blurred results on its IReV portal.

The court also ignored his position that certified true copies of documents that INEC issued to his legal team, comprised of 8, 123 blurred results that contained blank A4 papers, pictures and images of unknown persons, purporting same to be the CTC of polling units results of the presidential election.

“The learned justices of the court below erred in law and occasioned a miscarriage of justice when they held and concluded that he failed to establish the allegation of corrupt practices and over-voting,” his lawyer Livy Uzoukwu argued.
